On April 26, 2011, the public hearing for the Cyber Café was closed and the Board voted 5-0 to uphold the Building Inspector’s zoning decision that a special permit is required from City Council.
The Board will meet on May 24, 2011 (Tuesday) at 7:00 P.M. in Marlborough City Hall, 140 Main St., 3rd Floor-Memorial Hall, Marlborough, MA. to review the stenographer’s report and develop “Findings” for the below petition:
Applicant: Cyber Café of Mass. LLC – c/o Bacon Wilson P.C., 33 State St., Springfield, MA 01103
Property in question - 416 Boston Post Rd. East Unit #5 (within the Marlboro Square Plaza)
Petition: The Building Commissioner rendered a zoning decision that the “use” at 416 Boston Post Rd. Unit #5 (Zoning District Business, being Map 73, Parcel 30 of the Assessor’s Maps) is a place of assembly which would require a special permit from the city council. The Applicant feels that its “use” is permitted in a Business Zone and is appealing the decision of the Building Commissioner. Pursuant to Mass. General Laws Chapter 40A, Sections 8 and 15 and Sections of the Zoning Ordinance- Article I, § 650-5 and Article V, § 650-17.
